STEPS OR STAGES IN THE SALE OF LAND IN NIGERIA

Nigeria Limited v. Aderemi (1999) 8 NWLR (Pt. 614) 268, where the
court held observed that it is only after a binding contract for sale is
arrived at that the need to pursue the procedure for acquiring title will
arise. That is when obtaining of the necessary consent to alienate the property
becomes an issue in order top make alienation valid.
It was also in the above case
that stages of transfer of interest in land where divided into two distinct
stages viz:
1. The
contract stage (ending with the formation of binding contract for sale); and
2. The
conveyance stage (culminating in the legal title vesting in the purchaser by
means of the appropriate instrument under seal).
